These Terms of Service ("Terms") govern your access to and use of sundayresearchcommunity.com (the "Site") and registration for or participation in The Sunday Community (the "Community"), operated by Golden Spur Holdings ("Golden Spur Holdings," "we," "us," or "our"). By accessing the Site or registering, you agree to these Terms. If you do not agree, do not use the Site.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site or register for the Community. By registering, you represent that you meet these requirements and that the information you provide is accurate.
The Community
The Community is a free-to-join space for education, discussion, and access to informational resources. Membership is provided at no cost. We may change, suspend, or discontinue any part of the Site or Community at any time.
Registration
To join, you provide your name, email address, and phone number. You agree to provide accurate information and to keep it current. You are responsible for activity associated with your registration.
Communications consent
Electronic communications
You consent to receive communications from us electronically, including by email and, where applicable, text message, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
By registering, you agree to receive emails about the Community, including educational content and updates. You may unsubscribe from marketing emails at any time using the link in each email.
Text messages (SMS)
By providing your mobile number and opting in, you agree to receive recurring automated marketing and informational text messages from or on behalf of Golden Spur Holdings at the number provided, including messages delivered via an automatic telephone dialing system or similar technology. Consent to receive text messages is not a condition of registration or of any purchase.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for assistance. Carriers are not liable for delayed or undelivered messages. Text messaging is governed by this section and our Privacy Policy.
Acceptable use
You agree not to:
- Violate any law or the rights of others;
- Post or share content that is unlawful, harmful, harassing, deceptive, or infringing;
- Attempt to gain unauthorized access to the Site, disrupt it, or interfere with others' use;
- Use the Site or Community to send spam or to collect others' information without permission;
- Misrepresent your identity or affiliation.
Informational purposes only
Content made available through the Site and Community is provided for general educational and informational purposes only. It is not professional, medical, legal, or financial advice, and it should not be relied upon as a substitute for advice from a qualified professional. You are solely responsible for how you use any information.
Intellectual property
The Site and its content, including text, graphics, logos, and design, are owned by or licensed to Golden Spur Holdings and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. The Site and Community may link to or rely on third-party platforms and services. We are not responsible for the content, policies, or practices of any third party, and your use of those services is governed by their own terms and policies.
Disclaimer of warranties
The Site and Community are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
Limitation of liability
To the fullest extent permitted by law, Golden Spur Holdings and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or related to your use of the Site or Community. To the fullest extent permitted by law, our total liability for any claim relating to the Site or Community will not exceed one hundred U.S. dollars (\$100).
Indemnification
You agree to indemnify and hold harmless Golden Spur Holdings and its officers, members, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or Community, your content, or your breach of these Terms.
Termination
We may suspend or terminate your access to the Site or Community at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive.
Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Subject to the dispute-resolution section below, you agree that the exclusive venue for any dispute not subject to arbitration will be the state or federal courts located in Tarrant County, Texas, and you consent to their jurisdiction.
Dispute resolution and arbitration
Before filing any claim, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court. You and Golden Spur Holdings waive any right to a jury trial and agree that claims may be brought only in an individual capacity and not as part of any class or representative proceeding. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms.
Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and we will update the "Last updated" date above. Your continued use of the Site after changes are posted constitutes acceptance.
Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and Golden Spur Holdings regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them to an affiliate or successor.
